COURT OF APPEAL REJECTS CHALLENGE TO EXCLUSION ORDER The Court of Appeal has today delivered its judgement in the case of Mr. Christopher Connolly versus Bord na gCon (Irish Greyhound Board) and the Irish Coursing Club in relation to a challenge to an Exclusion Order issued in May 2018 in respect of Mr. Christopher Connolly. The Exclusion Order was issued by the Irish Greyhound Board with the consent of the Irish Coursing Club.
The appeal related to a High Court judgement in December 2018 when Ms Justice Pilkington of the High Court dismissed Mr. Connolly’s challenge to the Exclusion Order. In its judgement today, the Court of Appeal, in dismissing Mr. Connolly’s appeal stated, that the Court was satisfied that the appellant had every opportunity to present his case to the Board and that he was not deprived of his constitutionally protected right to fair procedures in the context of the investigation.
Frank Nyhan, Chairman of the Irish Greyhound Board indicated that ‘the IGB welcomes the fact that the Court of Appeal has dismissed the appeal and upheld the decision of the High Court. The decision of the High Court and today’s decision of the Court of Appeal supports the rigorous processes applied by the Board to the regulation of the industry. We will continue this approach to ensure the highest standards are maintained within the sport.’
An Exclusion Order, in accordance with the Greyhound Industry Act, 1958, prohibits a person from:
a) Being on any greyhound race track
b) Being at any authorised coursing meeting
c) Being at any public sale of greyhounds.

POSSIBLE REPRIEVE FOR ENNISCORTHY/YOUGHAL GREYHOUND STAR — MAY 6, 2020 greyhoundstar.co.uk/possible-reprieve-enniscorthy-youghal/A report from the Irish Greyhound Board (below) suggests that two of the tracks deemed surplus to requirements by the Indecon Report into the future of Irish greyhound racing, may have at least a short term reprieve.
Under the IGB sponsored plan, it was suggested that both Enniscorthy and Youghal had no viable futures. Two of the other tracks mentioned, Longford and Lifford have already closed. It now appears though as though the IGB are keeping their options open.
The IGB has received from Indecon the Independent Indecon assessment of Issues Arising on Consultation Submissions made on Indecon Strategic Review of Irish Greyhound Racing Stadia to Underpin a Viable Long-Term Sustainable Industry. This Indecon Report follows on from the open consultation process conducted by the Board when the original Indecon Report was published in December 2019. During the consultation phase, 48 submissions were received and all submissions have now been assessed by Indecon.
Indecon confirms the main conclusions and recommendations contained in its original report published in December 2019. Indecon points out that there are also new risks arising for the greyhound sector from the Corona virus pandemic which potentially impacts on the sector and should be taken into account.
The Indecon report on submissions presents three options to the Board of the IGB as follows:
Implement proposed restructuring and other decisions recommended by Indecon (in its original report published in December 2019). Provide an opportunity to Enniscorthy and Youghal for a fixed period of time to address challenges/issues identified and for key performance measures to be set. Not implement the recommendations of the Indecon Report. The Board has considered the additional report from Indecon and, given the current period of inactivity relating to the Covid-19 pandemic, the Board proposes to proceed with option 2 and offer a fixed period of time to Enniscorthy and Youghal to address challenges/issues identified in the overall report.
Contact has been made with Enniscorthy and Youghal tracks involved towards engagement with the IGB in relation to the approach agreed by the Board. It is in intended the matter will be further considered by the Board at its July 2020 meeting.

IGBThe IGB notes the Government decision today to permit horse racing with effect from 8th June 2020 and would have been of the understanding that such decision also extended to greyhound racing. This would not appear to be the case. The IGB has sought full clarity from the Department in relation to the decision.
Frank Nyhan, Chairman of the Irish Greyhound Board stated ‘Greyhound racing has proven its ability to run ‘racing behind closed doors’ and successfully complied with all COVID-19 protocols when operating on a closed doors basis during early March 2020. The strict enforcement of a ‘one person, one dog’ policy with a small number of regulatory personnel on site ensures a well-managed activity with all risks minimised. The extensive outdoor areas at our tracks enables social distancing requirements to be fully met without difficulty. The protocols operating during March have been enhanced and physical alterations are being undertaken at our stadia to further facilitate compliance with these enhanced protocols.
The IGB is at a loss to understand why, on a risk basis, greyhound racing is not assessed as being capable of operating behind closed doors from 8th June next as it is clear that all necessary protocols can be fully complied with. The IGB is absolutely intent on ensuring that all of its tracks and stadia operate to the necessary standards while COVID-19 remains with us. The arrangements already in place , and the further enhancements proposed ensure that the greyhound community can safely participate in racing behind closed doors and enable the greyhound racing industry to be restarted and provide an outlet for the health and welfare of our greyhounds. We are taking the matter up immediately with the Department of Agriculture, Food & the Marine to obtain clarification on the overall situation’.

BY RACING POST STAFF2:33PM 29 MAY 2020 From the Irish Greyhound Board's websiteThe IGB is currently operating on the basis of a resumption of trialling activity with effect from 8th June and a resumption of racing activity behind closed doors from 29th June 2020.
In the event that racing activity resumes earlier than 29th June, the Board will be in a position to accommodate same.
Significant work has been done on the compilation of a racing calendar for the remainder of 2020. The work on the calendar has been based on:
Ensuring that all Classic events, where possible, are held during 2020.
That the racing schedule caters for all categories of greyhound e.g. novice, juvenile, bitches etc. and all distances e.g. sprint, middle and long distance events.
Engagement with our sponsors many of whom, it is appreciated, are currently operating in a very difficult commercial environment.
The calendar below sets out the proposed racing schedule with effect from 29th June 2020. This schedule covers all major events. Local events will be dealt with at local track level in conjunction with the sponsors of these events.

The Irish Greyhound Board has announced that trials will recommence on Monday, June 8, which is the day horse racing is due to start in the country, with the target of behind-closed doors racing from June 29. The last racing in Ireland was at Shelbourne Park and Tralee on March 24.
An IGB statement read: “The IGB wish to advise all owners and trainers that trialling activity will resume at IGB licensed stadia from Monday, June 8 under strict Covid-19 precautionary measures.
“These measures are in the interest of safeguarding Public Health and adherence to same will ensure associated risks of Covid-19 transfer are minimised.”
Owners and trainers are requested to bring their own muzzles and jackets, while trials are strictly by appointment only.

After a brief, but longer than ideal hiatus, we’re back. Following the easing of Covid-19 restrictions, greyhound racing is set to return within days and preparations are in full flow.
Talking Dogs will be back to full capacity from next week and we can now look forward to what should be a pretty hectic few months of top-class racing action given the structure of the new feature events and classics calendar.
Great work has been done in recent weeks to ready our stadia for a safe return and, starting today, trial sessions will take place throughout the country ahead of a return to racing action.
It has been a surreal time but we can now finally start to focus on the future. I think I speak for all when I say it’s great to be back and stay safe. And please, if you are going to a track in the coming days and weeks, please follow the guidelines that have been put in place for your safety and the safety of others.
MATTTHEWS CONFIDENT FOR THE FUTURE
Speaking this morning while on the road to Shelbourne Park to school dogs, Damien Matthews, the chairman of the Irish Owners and Breeders Federation said, “It’s just great to be back.
I’m on my way to Shelbourne and I’m very optimistic that everything will run smoothly in the coming weeks.
“These have been trying times for all involved in the sport, but we can now look forward to getting back on track. I think all parties are rowing in the same direction to get the sport back on its feet and the social distancing measures should ensure everyone’s safety.
“It’s also wonderful not to lose the classics. It was quite a feat to sort out the calendar and we have a few months of brilliant racing to look forward to before the end of the year. I’m hopeful the future is bright
